These terms are an agreement between you and Relucent Labs LLC ("we", "us"), 12415 Tilton Trl N, Rogers, MN 55374, USA, for the Formology app and its online services (the "Service"). By ticking "I agree" or using the Service you accept them. If you do not agree, do not use the Service.
You must be at least 16 years old, and old enough to agree to these terms where you live. The Service is not offered in the European Economic Area or the United Kingdom. If you are under 18, a parent or guardian must agree to them for you. You must give accurate information when you sign up.
Strength training carries a real risk of injury, including muscle and tendon tears, joint and spinal injury, cardiac events and, rarely, death. Talk to a doctor before starting or changing an exercise programme, especially if you are pregnant, injured, or have a heart, joint or other medical condition.
Formology is a logging and educational tool. It is not medical advice, physical therapy, or a substitute for a qualified coach. You decide what to lift and how; stop if you feel pain, dizziness or shortness of breath. Use a spotter and safety equipment for heavy lifts. Keep your phone positioned where it cannot fall on you or anyone else.
Rep counts, form scores, angles, speeds and fault alerts are estimates made from your phone's camera. They depend on lighting, camera angle, clothing and what else is in view, and they can be wrong. AI coaching notes are generated automatically from those estimates and can also be wrong or incomplete. Do not rely on them alone to judge whether a movement is safe.
Keep your login details private; you are responsible for activity on your account. Tell us at support@formology.app if you think someone else has used it. You can delete your account at any time in Profile, Delete Account; what is deleted and what is kept is described in the Privacy Policy.
Do not misuse the Service. In particular, do not:
You keep ownership of the photos, measurements, workouts and feedback you give us. You give us permission to store and process them only as needed to provide the Service to you, as the Privacy Policy describes. If you send us feedback or suggestions, we may use them without obligation to you.
The app, its software, exercise models, designs and the Formology name and logo belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial training.
We may suspend or close an account that breaks these terms or puts other users or the Service at risk; where reasonable we will tell you first and why. You may stop using the Service at any time. Sections 2, 3 and 7 to 14 survive termination.
To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, including that it will be accurate, uninterrupted or error-free, or fit for a particular purpose.
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$50.
Nothing in these terms limits or excludes liability that cannot lawfully be limited, including liability for gross negligence, wilful or intentional misconduct, fraud, or (where the law forbids excluding it) death or personal injury caused by negligence. Some places do not allow certain exclusions, so parts of this section may not apply to you.
If you break these terms or the law while using the Service and that causes a claim against us, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.
These terms are governed by the laws of the State of Minnesota, United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Hennepin County, Minnesota. If you live outside the United States, you also keep any protection your local consumer law gives you that cannot be waived by agreement.
If you downloaded the app from Apple's App Store: these terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any claims relating to it, including product liability, legal or regulatory claims, or intellectual-property claims; those are our responsibility. If the app fails to meet an applicable warranty you may notify Apple, which may refund the purchase price; Apple has no other warranty obligation. You confirm you are not in a country subject to US embargo and are not on a US government list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
We may update these terms. We will change the date above, and for material changes the app will ask you to review and accept the new version before you continue. If you do not accept, you can delete your account. Questions: support@formology.app.
